• Client Account
  • That the User will provide full and accurate information
  • That the User shall be responsible for all activity of their account irrespective of their knowledge and/or express authorization to any person to do the same.
  •  The User is responsible for reporting unauthorized use

2.4 On submitting registration applications, the User shall be subject to a   verification procedure.

• Amendment to Content

3.1 eveghana.com expressly reserves the right in its sole discretion to effect any amendment or alteration to the content and information provided on its site.

• eveghana.com will not amend or alter any content provided directly by the User unless authorized by the User so to do, thus User content shall be the sole responsibility of the User.
  • Users acknowledge that it is their responsibility to familiarize themselves with any effected amendment or alteration.

• Privacy Policy & General Approach to Personal Data

4.1 eveghana.com respects the privacy of every User who uses the site. As a result of this, the site would like to inform User’s regarding the way personal data shall be handled and it shall be handled in accordance with the Data Protection Act, 2012 (Act 843) and only for the purpose set out in these terms and conditions

• By submitting your personal data to eveghana.com, it will be deemed to have been given with your permission, where necessary and appropriate for disclosures referred to in these terms and conditions.

4.4 eveghana.com will collect and use personal information solely with the objective of fulfilling those purposes specified and for other compatible purposes, unless it obtains the consent of the individual concerned or as required by law.

• Indemnity

6.1     In all instances the user indemnifies eveghana.com entirely for any unauthorized consequences arising therefrom.

• Users agree to indemnify and hold harmless eveghana.com, its officers, employees, servants, subcontractors, partners, subsidiaries, affiliates, advertisers, agents and representatives from any demand, liabilities, action or application or other proceedings and related costs made by any third party or user and arising out of or in connection with the user’s use of the site or any of the services offered through the site in any way including but not limited to the provision of content.
  • In particular it is recognized that eveghana.com cannot be held liable for any data costs incurred by the user or any third party when using the site.
  • To the extent that the User suffers damage or harm through the direct and indirect use of the site, the User indemnifies eveghana.com to the full extent of such loss and holds eveghana.com harmless.

• Users further Assurance
  • Users undertake not to impersonate any other person or use a false or unauthorized name so as to create a false identity or to misrepresent the origin or identity of any correspondence/communication
  • Users undertake not to make use of the site to collect harvest or obtain personal information relating to other users.
  •  Users shall not upload, post or transmit any content that is unlawful, illegal threatening, abusive, harmful, vulgar and obscene or constitute harassment, hate speech, invasion of privacy of another or otherwise objectionable content.

7.4       Users shall not upload, post or transmit any content that infringes the intellectual property rights of a third party or which the member is restricted from uploading, posting or transmitting by operation of law, contract or duty of care.

7.5      Users shall not use the site to engage in any unlawful or unauthorized activities outside the scope, spirit and purpose of eveghana.com

7.6     Users shall not transmit any content designed to disrupt the site or any service provided on it.

• Intellectual Property Protection
  • Copyright in all information, images and other original material owned and published by eveghana.com and not attributed to a third party is held by eveghana.com and eveghana.com asserts and reserves all its rights including moral rights in this regard.
  • Eveghana.com reserves the right in its sole and absolute discretion and without prior notification, to terminate the access of any user who goes in contravention to the site’s terms and conditions.

• Governing Law
  • The user agrees that the law applicable to these terms and conditions of use, their interpretation and any matter or litigation in connection herewith or arising therefrom will be the law of the Republic of Ghana.
  • When using the site and agreeing to these terms and conditions such use and agreements are deemed to have taken place within the Republic of Ghana.
  • Any dispute between eveghana.com and the user arising out of or in connection with these terms and conditions including any questions regarding its validity or termination shall be settled in accordance with the Alternative Dispute Resolution Act, 2010 (Act 798) and the dispute will be resolved in accordance with the laws of the Republic of Ghana.

   1. Owing to legal and other developments, eveghana.com may be required to amend these terms and conditions of use from time to time.
   1. eveghana.com will attempt to give notice of any amendments but reserves the right to effect binding amendments, additions or deletions without notice.
   1. eveghana.com reserves the right to change these terms & conditions. These terms & conditions will become effective from the date on which they are posted on the site. Accordingly, it is the User’s responsibility to check the site from time to time to see whether the terms have been changed. A User’s continued use of the site will be deemed to be an acceptance of the amendments to the terms and conditions.
   1. Other than the variation of these terms and conditions by eveghana.com, placing such amendment on the site as mentioned above, no addition to, variation of, novation, or cancellation of these terms and conditions shall be of any force or effect unless in writing and with the consent of eveghana.com.

1. Severability
   1. Should any provision of these terms be void for vagueness or for any other reason, then that provision of this Agreement shall be capable of being severed from the remainder of these terms which shall remain of full force and effect.
   1. The User confirms that the provisions of these terms are in plain and understandable language and that they understand the provisions contained herein.
   1. Users may not cede, sub-license or otherwise transfer any rights they may have under these terms and conditions or which may otherwise have been obtained through the use of this site.

1. Entire Agreement

12.1 These terms and conditions constitute the sole understanding between eveghana.com and the User and supersedes any previous agreements. Neither party shall be bound by any representations, express or implied, warranty, promise or the like not recorded in this agreement.
